Contest Rules

1. ELIGIBILITY:
1. The Contest is open to anyone who is a legal resident of, or domiciled in, the 50 United States and the District of Columbia 18 years of age or older (19 years or older in Alabama and Nebraska) at the time of entry. All natural persons making a creative contribution to, or appearing in, the Contest entry must also meet the requirements of this paragraph.
2. MyDomain and its affiliates, subsidiaries, agents, distributors, wholesalers, retailers, sales representatives, and their advertising and promotional agencies and suppliers of promotional materials, their respective employees, and their respective immediate family and household members are not eligible.
3. Internet Domain name registrars and web hosting companies, their employees, and their respective immediate family and household members are not eligible.
4. The Contest is subject to all federal, state, and local laws and regulations. The Contest is void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and otherwise where prohibited, taxed or restricted by law.
5. Only one entry is allowed per Entrant.


2. HOW TO ENTER: There are two ways to enter the Contest
1. Complete the entry form located at www.mydomain.com/brandme/ during the Entry Period; or
2. Hand-write or type the words "MyDomain's Brand .ME Contest," your name, address, telephone number (including area code), and email address, and provide the information required in the entry form, specifically:
   1. Category Entrant wants to be considered for (each a "Category"):
   1. "Best Career" (job hunting personal brand); or
   2. "Best Hobby" (interest personal brand); or
   3. "Best Subject Expert" (expert personal brand).
   2. The URL of the website Entrant wants to submit ("Initial Website"); and
   3. One paragraph about Entrant's personal brand and what Entrant wants to accomplish with it.
   
   on 8½" x 11" white paper, and mail it in an envelope with first class postage affixed to the address above. All mailed entries must be received by April 8, 2010. No mechanically reproduced entries or entries submitted by facsimile will be accepted. MyDomain assumes no responsibility for late, damaged, ineligible, incomplete, lost, postage-due or misdirected entries. All entries are the property of MyDomain and will not be returned.


3. If selected as a Finalist (as defined below), Entrant will be allowed to submit up to three (3) additional website URLs (each, including the Initial Website, considered a "Website") in the same Category. Websites will be posted for public voting from April 19, 2010, through April 28, 2010.


3. FINALISTS:
   Five (5) finalists will be chosen from the eligible Website entries in each Category to receive the Finalist Prize (described below) on or about April 9, 2010. Entrants who are selected as potential Finalists will be contacted by email. If a potential Finalist cannot be contacted within three (3) days after the first attempt, MyDomain may select an alternate potential Finalist in his/her place from all eligible entries received. You are not a Finalist until (a) your eligibility has been verified, (b) you have signed the required affidavit and release, and (c) you receive official notification from MyDomain that you are a Finalist. See below for further details.


4. WINNERS' PRIZES
1. FINALIST PRIZE(S). Five (5) Finalist winners will be chosen from the eligible entries in each Category to receive a Finalist Prize (described below) on or about April 9, 2010. Odds of winning a Finalist Prize depend on the number of eligible entries.


2. GRAND PRIZE(S). One (1) Grand Prize winner will be chosen in each Category to receive the Grand Prize (described below) on or about May 4, 2010. Odds of winning a Grand Prize depend on the number of eligible entries.


3. PRIZE VERIFICATION AND AWARDS PROCESS. Potential Grand Prize and Finalist Prize Winners (potential "Winners") will be contacted by email and/or telephone. Each potential Winner must satisfactorily complete the verification process in order to win the prize indicated, subject to these Official Rules. If a potential Winner cannot be contacted within three (3) days after the first attempt, MyDomain may select an alternate potential Winner in his/her place from all eligible entries received. You are not a Winner until: (a) your eligibility has been verified, (b) you have signed the required affidavit, warranties and release, and (c) you receive official notification from MyDomain of the final prize award.


4. AWARD CONDITIONS. All prize awards are contingent upon the Entrant fulfilling all terms and conditions of these Official Rules. All potential Winners are subject to verification by MyDomain, whose decision is final and binding in all matters related to the Contest. Within 21 days after the date on the initial notification letter from MyDomain, each potential Winner will be required to sign an affidavit of eligibility, a warranty that all rights in the Website have been cleared and required releases obtained, and a release of liability/publicity (where permitted). If the conditions of this paragraph are not completed within the specified period, the prize will be forfeited and awarded to an alternate Winner. If any prize or prize notification is returned as undeliverable, the prize will be forfeited and awarded to an alternate Winner.


5. JUDGING:
1. Finalists will be selected by MyDomain based on Entrant's quality of Initial Website content (writing, grammar, quantity) (25%), ability of Initial Website to convey personality of owner (25%), ability of Initial Website to convey professional skills and strengths (25%), and creativity of written response paragraph submitted with the Initial Website (25%). Potential Finalists will be selected on or about April 9, 2010, from all eligible entries received during the Entry Period. By participating, Entrants agree to be bound by the Official Rules and the decisions of the judges, which shall be final and binding in all respects.


2. Grand Prize winners will be selected by MyDomain based on the Finalist score (30%), the number of votes received for Entrant's Website (30%), total size of online presence of the Website (number of social networks, visibility in Google search results) (20%), online influence (size of social network followings and connections) (10%), and overall personal brand displayed on the Website (10%). MyDomain may use the winning Websites in advertising and promotion; therefore, Websites may be disqualified if they cannot lawfully be so used (due, for example, to failure to comply with intellectual property, defamation, unfair competition or advertising laws). Winners will be selected on or about May 4, 2010, from all eligible entries received during the Entry Period. By participating, Entrants agree to be bound by the Official Rules and the decisions of the judges, which shall be final and binding in all respects.




6. PRIZES:
1. FIFTEEN (15) FINALIST PRIZES: Each Finalist Winner will receive a prize package that includes a one-year registration of a .ME domain and one-year Linux Basic Hosting package (approximately retail value of US$75.00).


2. THREE (3) GRAND PRIZES: Each Grand Prize Winner will receive an Apple® gift card in the amount of US$1,000.00 (retail value of US$1,000.00) ("Grand Prize"). Use of such gift card is subject to any and all terms and conditions applied by Apple® to its gift cards.


3. All expenses and costs not expressly listed in the prize descriptions above are solely the winner's responsibility. Prizes are nontransferable until awarded and non-refundable and must be accepted as awarded. No cash or other substitution may be made except by MyDomain. MyDomain reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by MyDomain in its sole discretion. All prize winners are solely responsible for all taxes associated with the receipt of any prize.


4. Prize winners who meet all of the eligibility requirements, are verified, and have fully complied with these Official Rules, will receive their prize within four (4) weeks of selection and verification.




7. GENERAL CONDITIONS:
1. MyDomain assumes no responsibility for late, damaged, ineligible, incomplete, lost, postage-due or misdirected Websites. All received entries are the property of MyDomain and will not be returned.


2. MyDomain reserves the right to cancel, suspend, and/or modify the Contest for any time and for any reason, including if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Contest, as determined by MyDomain in its sole discretion.


3. MyDomain reserves the right in its sole discretion to disqualify any individual or Entrant it finds to be tampering with the entry process or the operation of the Contest, or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law. Should such an attempt be made, MyDomain reserves the right to seek damages from any such person to the fullest extent permitted by law.


4. MyDomain assumes no responsibility for (i) any error, omission, interruption, deletion or defect in information, whether caused by MyDomain's website, users, entrants or other causes; (ii) any theft, destruction or alteration of entries, or any unauthorized access to entries; (iii) any problem with or technical malfunction of any telephone network or telephone line, computer on-line system, server, provider, computer equipment, software; (iv) any failure or delay of any email or entry to be received by MyDomain on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof.


5. MyDomain's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.




8. AGREEMENT TO OFFICIAL RULES:
   Your participation in the Contest constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of MyDomain, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.


9. PUBLICITY:
   Except where prohibited, participation in the Contest constitutes winner's consent to MyDomain's use of winner's name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media worldwide without further payment or consideration.


10. OWNERSHIP OF ENTRIES:
    All intellectual property right, title, and interest in submitted Websites shall remain the property of the submitting Entrant. Notwithstanding the foregoing, each Entrant hereby grants MyDomain a nonexclusive, perpetual, royalty-free, fully paid, irrevocable, and worldwide license to use, reproduce, distribute, modify, have modified, create, and have created derivative works from, transfer or sublicense to others and otherwise directly and indirectly exploit the Websites. By submitting a Website, you represent and warrant to MyDomain that (a) the Website is your original creation, (b) you have obtained sufficient copyright and intellectual property clearances to permit MyDomain to exercise the license granted in this Section, and (c) you have obtained all necessary talent and location releases.


11. RELEASE:
    By receipt of a prize, Winner agrees to release and hold harmless MyDomain and its officers, directors, shareholders, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Contest or the receipt or use of any prize.


12. LIMITATIONS OF LIABILITY
    The Released Parties are not responsible for: (a) any inaccurate information, whether caused by Entrants or printing errors; (b) unauthorized human intervention in any part of the Contest; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Contest or the processing of Entries; (e) lost, delayed, misdirected, or undeliverable mail; or (f) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Contest or receipt of any prize.


13. DISPUTES:
    Except where prohibited, you agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Washington; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Contest, but in no event attorneys' fees; and (c) you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of MyDomain in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Washington.


14. INTERNET SWEEPSTAKES PRIVACY POLICY:
    By entering this Contest, you agree to the use of your personal information as described in the Official Rules and in MyDomain's Privacy Statement located at www.mydomain.com. Apple® is a registered trademark of Apple, Inc. Apple, Inc., is not affiliated with MyDomain or the Contest.


15. ODDS OF WINNING:
    Odds of winning depend upon the number of entries received.

Washington and Vermont residents may omit return postage for Official Rules requests.
